Our weekend edition of the “Top 20 … plus more” … a snapshot of some interesting e-discovery blog/web site posts, vendor news/views on a wide range of electronic discovery related issues, and other tech developments from the past week. Spotlight: Apple and Samsung learn about ediscovery!
As we reported last week (click here), the jurors in the monster mobile phone/intellectual property trial between Apple and Samsung received an adverse inference instruction with respect to Samsung’s spoliation of evidence. This coming several months after Samsung had done an 11th hour data dump on Apple of millions of Korean language documents — causing Apple’s attorneys to do a last minute nationwide recruitment of Korean fluent contract attorneys. So much for “playing nice” and the spirit of “meet and confer”. The Posse List was busy for two weeks posting recruitment notices for Korean fluent attorneys.
And then later this week Samsung got reproached by the court again over a controversial press release which complained about the court’s exclusion of evidence favorable to Samsung (click here). Some pundits have smirked at Samsung’s “what? influence the jury?! Never!” protestation. But Nick Staines … a member of the Project Counsel Media team at the trial … says some at the trial thought it might have actually been an attempt at causing a mistrial (click here).
