WEEKEND FOCUS >  Anonymity?  Ha.  It’s becoming alogrithmally impossible  

Has Big Data made anonymity impossible?  As the amount of data expands exponentially, nearly all of it carries someone’s digital fingerprints. According to International Data Corporation (IDC), the amount of data created in 2012 reached a whopping 2.8 zettabytes — that’s 2.8 trillion gigabytes — and that number is predicted to double by 2015. Most of it is made by individuals as they go through their daily interactions, and consequently, as tracking and storing of that data improves, analysts are able to learn even more about those people. All of this is leading to a day when, according to computer scientist Arvind Narayanan, it will be “algorithmically impossible” to be truly anonymous.

WEEKEND FOCUS >  ”The Importance of Making Big Data Accessible to Non-Data Scientists”

Gartner analyst Doug Laney first coined the term ”big data” over over 12 years ago although one suspects — at least in its current form — people have been complaining about “information overload” since Roman times. But the term’s meaning is still far from clear and it wins continuous nominations in the “Tech Buzzword That Everyone Uses But Don’t Quite Understand” competitions, followed closely by “the cloud”.

When using the term, Gartner usually keeps the quote marks in place (i.e. it’s “big data”, not big data). And as we learned at the Gartner Business Intelligence and Analytics Summit in Barcelona two months ago, Gartner has spent a tremendous amount of time on it. As Gartner analyst Donald Feinberg warned people at the conference “talking only about big data can lead to self-delusion” and he urged people not to “surrender to the hype-ocracy.”

NOTE: next month we’ll have a chance to talk about “big data” more with Gartner analyst Debra Logan along with Jason R. Baron when our video crew travels to Rome to interview them at the 14th International Conference on Artificial Intelligence and Law.

But some interesting points in the Gartner analysis and predictions for Big Data and data analytics in the coming years. Gartner forecasts that by 2016, 70 percent of leading business intelligence vendors and information governance support vendors will have incorporated natural language and spoken-word capabilities, a trend that has hit about 25-30 percent of these vendors today. Improving natural language queries is essential to the consumerization of Big Data, as it better enables everyday business users to ask questions of their analytics tool in an intuitive format (text, voice-enabled, etc.), and receive the most relevant and meaningful visualization results. As Gartner points out, these vendors have focused heavily on optimizing applications for smartphones and tablets to meet demands of the increasingly mobile workforce. Gartner anticipates a progression to voice-enabled commands first, followed by natural language processing of spoken or text input into SQL queries.

Acceleration of natural language capabilities does not diminish a role for skilled data scientists trained in conducting deep analysis many organizations require. But in some cases, deep analysis isn’t needed. Enabling business users (and we include lawyers in that bunch) to ask straightforward questions in natural language helps to quickly engage the user and requires no training.

And this has grown in importance for information governance support vendors. Lawyers, as a group, tend not to be technically savvy. Lawyers like to ask “where in the data is ….” and really do not want to know/need to know the complex machine learning algorithms. The semantic brain needs to deliver a relevant answer to the user. And because “the answer” is mostly a combination text-based documents with unstructured transactional data users now expect the answer to be presented via visualization – and they expect to be able to interact with the visualization.

Having met with the brain trusts behind companies like Digital Reasoning, Logikull, SAS and ZyLAB, you realize that the leaders of these companies understood this need which is why they are among the leaders in data analytics and data visualization. As Johannes Scholtes, Chairman and Chief Strategy Officer of ZyLAB, told us in a recent interview “while data scientists and others skilled in navigating through large data sets can do so efficiently, lawyers do not have the time … or sometimes the patience … to repeat the same queries over and over again so it is our job to build data analytics tools, visualization tools that complement the user behavior”.

An excellent data visualization, according to Edward Tufte who we saw at a presentation for lawyers and C-level suite attendees, expresses “complex ideas communicated with clarity, precision and efficiency.” I would add that an excellent visualization also tells a story through the graphical depiction of statistical information. As we wrote over two years ago when we first addressed this topic, the information governance/analytics industry was moving/has moved to the point where it can produce a compelling narrative, using data visualization “to tell a story” to its lawyer audience. The acceleration of natural language capabilities and continuing development of deep analysis tools will make this even more prevalent. And now with Google Research and the IBM Watson team applying their massive resources to the field of legal search it can only get better.

In the course of writing our e-book IBM: a culture of analytics we have been somewhat overwhelmed by the amount of material made available by IBM as well as our independent sources. Last week we were … once again … astounded by the technology this company can produce. It was the announcement that a movie IBM created has been certified by the Guinness Book of World Records as the smallest movie ever made. It’s called “A Boy And His Atom” and the medium of animation is … you guessed it … atoms.  

The animated film features a small boy having a good old time as he bounces around, playing catch, and dancing.

The twist? The film was shot at the atomic level and features 130 atoms that were painstakingly placed, atom by atom, as the researchers shot 250 individual frames. The images were created at a temperature of negative 268 degrees Celsius and were magnified 100 million times. It lasts all of 60 seconds, and depicts a boy … made up of individual atoms himself … encountering a single atom that he befriends and throws like a ball. He then bounces up and down on a tiny trampoline made up of atoms, then throws the original atom into the sky, where it erupts into a tiny commercial for the company that produced it: IBM.

What’s going on here is this: scientists at IBM’s Almaden Research Lab in San Jose, Calif., have figured out a way to precisely move and manipulate individual atoms. To do it they’re using a big piece of equipment called a scanning tunneling microscope that weighs two tons and operates at a temperature of minus 268 degrees Celsius. In the world of physics and nanotechnology, this thing is a big deal and led the two IBM inventors to share the Nobel Prize for Physics in 1986.

We are going to have a much longer piece on all of this in a few weeks but suffice it to say the ability to move single atoms, one of the smallest particles of any element in the universe, is crucial to IBM’s research in the field of atomic-scale memory. In 2012, IBM scientists announced the creation of the world’s smallest magnetic memory bit, made of just 12 atoms. This breakthrough could transform computing by providing the world with devices that have access to unprecedented levels of data storage. But even nanophysicists need to have a little fun. WEEKEND FOCUS>  ”Computing the Return on Investment (ROI) in e-Discovery”

There has been a flood of analysis of late on computing return on investment (ROI) in e-discovery, employing the same technology companies use to gathering data on how much it costs to handle a business process, how much can be saved with improvements, and establishing that the savings will justify the cost of the improvement. Every e-discovery vendor seems to have a calculator, and there are dozens of apps on iTunes.  In financial circles, ROI is actually a more complex analysis, but it’s still a good acronym for our purposes. Much of this ROI analysis was discussed in the constantly cited Rand report Where the Money Goes: Understanding Litigant Expenditures for Producing Electronic Discovery.

Richard Medina, a co-founder and a Principal Consultant at Doculabs who we met via our work at The Cloud and E-Discovery, has put together a case study to explain how to calculate the ROI for improving the e-discovery process. For his analysis, click here.

WEEKEND FOCUS>  ”In the wake of the Boston Marathon bombings a new hero emerges: technology”

In the wake of the Boston Marathon bombings – which brought many reminders of 9/11 – we saw a new hero emerge: technology. The fast responses of medical professionals already onsite likely saved numerous lives. Furthermore, those runners that finished the race and then continued on to donate blood at the local hospital should be praised as well. The human element, no doubt, played a vital role in minimizing casualties and helping people get medical attention quickly.

But as we read and analyzed the situation, saw what law enforcement and public officials were doing, we saw the new tools at their disposal, all from technology.

First, a very big hat tip to Gerry Norton, an ex-Marine buddy of The Project Counsel Group boss/founder. Gerry is now a security consultant but spend 20+ years in various U.S. agency intelligence positions. We spent a lot of time with him as he explained all the various video content analysis (VCA) software technology that was in use, its capability of automatically analyzing video to analyze events, the complex algorithms involved to execute video motion detection, video tracking, identification, behavior analysis, etc. that resulted in producing the video of the two suspects. As he said “it is simply … or perhaps not so simply … a computer-assisted replication of the visual cortex sitting in our brain”.

For those of us in the e-discovery world, it is not so new. If you have been to any of the e-discovery technology bazaars like LegalTech or IQPC Exchange, you have seen the information-crunching software of companies like Autonomy and ZyLAB … software used by scores of law enforcement entities world-wide … that analyze video data with advanced recognition and recording systems, intelligent scene analysis systems, etc. In addition, if you have been to the numerous digital forensics events you have seen the video content analysis technology developed by companies such as Apple (which recently won a face-recognition patent), AxxonSoft, Bosch, Intel, Kiwi, etc.

We suspect there will be a tsunami of articles to come on all of this technology from various vendors and intelligence sources.

And then there is what Boston Police Commissioner Ed Davis called “the Good Guy Multiplier”. The finish line of the Boston Marathon is one of the most well-photographed and documented areas in the country. Although the crime scene was complex, the use of technology pinpointed the time line of events. In 2001, the prevalence of recording and digital equipment was not anywhere as high as it is today. On April 15, 2013, a lot more “eyes” were watching the course of the day unfold.

Bill Kleyman of MTM Technologies, a company we work with via our Big Data-Cloud-Ediscovery site, sees three areas where technology was involved in the event and aftermath:

• IT consumerization. Yes, that “God-please-stop-with it” marketing term, along with BYOD. But as Bill says the true magnitude of IT consumerization was on display. Because so many people have cell phones or other devices with cameras, thousands of high-quality photos were taken from almost every angle and vantage point during the Boston Marathon. People were on the ground, in buildings, at the finish line and everywhere in between. Within minutes, photos of the bombing were circulated and analyzed and pieced together through an array of advanced technologies.

Note: modern phones are capable of taking 8-12 megapixel images. Compare that with phones from 2002 which could only do 0.3MP. As people took videos and photos documenting the event, these digital images are higher resolution than ever before, capturing more image and allowing details to be used by authorities.

• Everyone has become a “digital technician.” All across the web, amateur digital technicians were examining photos and processing individual video frames to catch inconsistencies. Just like law enforcement, these technicians have an eagle-eye for technology and can actually help officials pinpoint irregularities. Cloud computing and social media have been busy sharing pictures; discussing analysis of the event and helping everyone involved understand what happened.

• CCTV and surveillance. Along the entire route … 26 miles of very public road … there were hundreds of cameras and CCTV instances where live video was recorded and documented. In the immediate area of the blasts, numerous retail store and bank high-quality outdoor security cameras helped police identify people of interest. The ability to zoom into a face or feature was paramount. These technologies are becoming more and more prevalent where high-quality feeds are capable of doing so much more than ever before. As Gerry Norton had told us, officials can use every single frame from every source and literally put together “the footsteps” of almost anybody they wanted.

• Social media and the cloud. The events were captured both on video and, simultaneously, on the Internet. Social media reports were posted as quickly as professional reporters brought the news on TV, radio or Internet. Twitter, Facebook, and other heavily used sites became hot spots for conversation. Social media served as a way to determine if friends and family on the ground were alright. Above anything else, social media (and cloud computing) helped bring people together. Whether it was words of support, an image of a friend, or just a thought posted on Facebook, technology pushed aside human differences and the sharing through social networks brought everyone closer together.

Bottom line: everyone from pro photographers to ordinary people with their high megapixel smartphone cameras helped authorities solve one of the most complex crime scenes in recent history.

WEEKEND FOCUS>  ”Laws as algorithms: converting simple laws to machine-readable code”

The legal industry remains Lady GaGa-ed with Richard Susskind and his pronouncements on the deep and rapid technological advances (of the disruptive kind) leading to major threats to various aspects of the traditional law firm business model, and the relentless connectivity in the burgeoning electronic legal marketplace. He has his critics and even he was somewhat self-deprecating in a recent Oxford University Press blog when he said “the uncharitable might say that I write the same book every four years or so. Some critics certainly accuse me of having said the same thing for many years. I don’t disagree. Since the early 80s, my enduring interest has been in the ways in which technology can modernize and improve the work of the legal profession and the courts. My main underpinning conviction has indeed not changed: that legal work is document and information intensive, and that a whole host of information technologies can and should streamline and sometimes even overhaul traditional methods of practicing law and administering justice.”

His recent book does have a lot of repetition but he expands on his previous work and talks about enabling technologies, the legal world shifting from cottage industry to IT-enabled information sector, and neural networks. For more click here.

But the fellow that most legal industry thought leaders read when it comes to the future of legal technology is Peter Thiel. I had the opportunity to meet him at a Le Web conference two years ago, and a technological singularity event in New York. Most of our readers know Thiel’s place in the technology ecosystem but for those that may not some (very) brief highlights:

1. A graduate of Stanford Law School, he co-founded PayPal with Max Levchin and served as its CEO.

2. He is managing partner of The Founders Fund which he launched with Ken Howery and Luke Nosek in 2005.

3. He was the first outside investor in Facebook and remains on its Board. He was not actively involved in running it but Zuckerberg credits him for providing the key help with timing the various rounds of funding. Zuckerberg says Thiel helped time Facebook’s 2007 Series D to close before the 2007-2010 financial crisis.

4. He believes in the importance and desirability of a technological singularity and set up the Machine Intelligence Research Institute (then known as the Singularity Institute for Artificial Intelligence).

5. This list could go on and on but let’s stop there.

Thiel has spoken and written about how one day artificial intelligence will progress to the point of bringing us a totally computerized justice system. But when lawyers think about it, they first think about a computer judge. And when they think about a computer judge, either they are skeptical or they are afraid that such a thing could actually sit in a court one day. And because lawyers are so adverse to change they protest that the current state of the justice- as delivered by expert human judges- is pretty good (fair decisions, timely delivered, almost free of mistakes), and a computer judge will most probably turn into a hellish HAL 9000 sooner or after.

Thiel notes both assumptions are flawed. Look at the data. Indeed the State of the Art in justice is far from being optimal (judges do make mistakes); and we can’t predict yet if a machine judge will do a good or bad job so any futuristic-Space Odessey scenario is flawed anyway.

But that doesn’t mean we are not moving toward it. You only need to see what companies like Google, IBM and Microsoft are doing with artificial intelligence-based inductive learning algorithms in legal search and the legal domains. Or look at the work of the MIT Reseach Labs and the Swiss artificial intelligence lab IDSIA.  Yes, artificial intelligence implementations to legal process is problematic and will not be smooth.

But I present to you Exhibit A:

Four academics from West Point and Samford University in Alabama set out to answer a seemingly simple question: how would one write a computer program to issue speeding tickets? After all, speed limits are fairly simple—you’re either driving faster than the posted number or you’re not.

In the age of Google and its competitors making fully autonomous cars (and states passing laws to allow them), it’s not hard to imagine fully autonomous law enforcement for traffic violations, either. After all, we already have red-light cameras.

“If anyone thinks it is a simple thing to do, to take a simple law [and convert it to machine-readable code], it is significantly more complicated than one thought,” Woodrow Hartzog, a law professor at the Cumberland School of Law at Samford University.

But they did it. As they said in their paper describing their work:

“Due to recent advances in computerized analysis and robotics, automated law enforcement has become technically feasible. Unfortunately, laws were not created with automated enforcement in mind, and even seemingly simple laws have subtle features that require programmers to make assumptions about how to encode them. We are rapidly entering an era when some robots will be commonly programmed to either enforce or comply with various laws. This is particularly true in many consumer, industry, and military contexts, such as with motor vehicle operations for perceived cost savings, public safety gains, and law enforcement efficiency. We demonstrate this with an experiment where a group of 52 programmers was assigned the task of automating the enforcement of traffic speed limits”.

WEEKEND FOCUS>  ”Breaking through the dense fog of predictive coding”

Rob is taking a well-deserved break this week so we thought we’d draw attention to a few items on his web site … a phenomenal resource … concerning a subject rarely addressed, predictive coding.

While the promise of predictive coding’s potential for reduction of e-discovery costs slooooowly works it’s way through the legal industry (an industry always reluctant to accept change), a dense fog remains. As we have discussed with Rob, legal vendors frequently tout their approach, their methodology as being superior to all other variations. And with very, very big money involved …. well.

Rob has tried to dispel this fog by providing three very useful sources:

1. He has put together what he has called a “Predictive Coding One-Question Provider Implementation Survey” with one goal in mind: to provide a specific and detailed look at the use of the technology-assisted review feature of predictive coding among leading e-discovery providers as represented by those providers. The specific technologies highlighted in the one-question survey include active Learning, language modeling, latent semantic analysis, relevance feedback, etc., etc. You can read the initial results by clicking here.

WEEKEND FOCUS>  ”"ENOUGH with computer assisted review, already!!”

Ok, granted.  The e-discovery industry runs in packs.  Awhile ago one vendor had legal project management, then EVERYBOY had it.  One vendor came out with early case assessment, then EVERYBODY had it.  One vendor had a legal hold tool, then EVERYBODY had one.  Now … well, now computer assisted review (CAR).  And it is not just that EVERYBODY has.  It seems EVERYBODY has a webinar on it.  And it must be confusing to the end users.  As one Chief Legal Officer from a Fortune 100 company told us at LegalTech “they are struggling to differentiate themselves with a technology that has become commoditized, and act as if it is the only tech out there”.

Well, not everybody in the industry says that or feels that way.  Ralph Losey … the Grand Doyenne (Doyen?) of the e-discovery cosmos … has long championed a multimodel approach to information retrieval in general, one that utilizes all types of search methods, including predictive coding.

As does Adam Wright Strayer of Complete Discovery Source who in this past week’s edition of The Metropolitan Corporate Counsel says you need to look at traditional document review, analytical threading, conceptual searching and clustering, plus what he calls “almost TAR”. Sorensen Capital takes a large chunk of AccessData, IBM buys StoredIQ, CPA Global acquires First to File, DTI acquires Fios, Digital Reef gets gobbled up by TransPerfect, etc., etc. And with three more acquisitions in the wings for 2013 how can you possibly keep up with all of this acquisition and investment activity in the e-discovery world?
