This week’s spotlight: The International Journalism Festival in Perugia, Italy

Yes, yes. We have it. All that analysis on what the Judge Carter decision in the Da Silva Moore predictive coding case means/doesn’t mean. Rob Robinson has done his usual masterful job in collecting the posts and they are below.

But for something completely different we have a report on The International Journalism Festival held last week in Perugia, Italy.

The Festival is held annually in Perugia which is about 160 kilometers (about 100 miles) from Rome. And since we were in Rome on a long-term e-discovery document review and wanted a break we figured … eh, why not go? Especially since our mates from Project Counsel Media were there. There were a host of excellent presentations such as “how not to get killed in a war zone”, finding stories with Big Data analytics, ”are lawyers killing investigative journalism?”, etc.

30 April 2012 - One of our sister company’s, EAM Capital Partners, attended the Mobile World Congress in Barcelona and posted their review today. Part of it discusses some of the e-discovery aspects of the mobile industry, the advance of the “mobile first” world and it’s effect on all industries. As the folks from Forrester said at their presentation “companies need to realize that mobility is the new front end for engagement systems. Apps are increasingly context aware, fed by the cloud, sensors, history and social data. That requires companies to reconsider how they deploy apps for customers, partners … but especially employees around this enhanced form of engagement”. Bravo. Mobile apps from companies can’t just log data, they need to harness all the power of mobile and social to help people get specific jobs done in any particular industry.

And so it will be for e-discovery applications based on the “industrial strength” presentations we saw at LegalTech.

27 April 2012 - On April 26, 2012, in a ruling that had the potential to profoundly influence the use of predictive coding in the Southern District of New York, Judge Andrew L. Carter, Jr. instead took a measured and cautious approach. Judge Carter rejected plaintiffs’ objections to Magistrate Judge Andrew J. Peck’s much discussed endorsement of predictive coding in Da Silva Moore v. Publicis Groupe SA but did so on procedural grounds and stopped short of embracing predictive coding as a panacea for the mounting challenges of e-discovery.

Disclosure of Document Review Methodology – Should You or Shouldn’t You?

27 April 2012 – In a recent article in the New York Law Journal, Robert W. Trenchard and Steven Berrent examine an important question facing litigants in discovery: If the litigant decides to rely on “novel” methods of document review involving advanced analytics or predictive coding technologies, must they disclose those methods to the opposing party? The authors present several compelling arguments in favor of candid, transparent disclosures around document review methodology, including:

Savings of time and expense – and increases in efficiency – of the discovery process
Reduction in the frequency and scope of discovery motion practice
Establishing the reasonableness of steps taken to prevent inadvertent disclosure of privileged information, which is a pre-condition to using the non-waiver protections of Federal Rule of Evidence 502

On the other hand, the authors also note equally persuasive reasons NOT to disclose certain aspects of the methods used to review documents.

This week’s spotlight: the DLA Piper Data Protection Law Handbook

This past January the European Commission proposed far-reaching changes to rules dictating how companies handle any personal information, the first time EU regulations first crafted in 1995 are to be updated. The proposals will impose a single set of privacy standards in the EU’s 27 countries for the first time, overriding often divergent national rules. As companies struggle to protect and safeguard personal information, managing the legal responsibilities related to processing personal data consistent with applicable laws is a growing challenge. To the rescue comes DLA Piper. The DLA Piper Information Law Team have published a handbook with an overview of the applicable privacy and data protection laws and regulations across 58 different jurisdictions, including a section on enforcement (click here).

This week’s spotlight: the “other” predictive coding case

While the eDiscovery world seems glued to the comings and goings of the Da Silva Moore v. Publicis Groupe predictive coding case, over in Merry Olde Illinois there has been another case, Kleen Products v. Packaging Corporation of America, which could potentially change the way parties are expected to handle eDiscovery in the future.
